Minutes of Meeting – September 7, 2010
The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.
At 7:00 p.m., Bob D’Amelio called the meeting to order.
Present: Bob D’Amelio, Tom Collins, Dirk Underwood, David Daigneault, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

15 Lakeshore Drive
Present was: Tom DiPersio, Jr., Thomas Land Surveyors
Mr. DiPersio presented the plan to the Board. Mr. DiPersio explained that the applicant is seeking to make a simple land swap with the neighbor in order to bring the existing garage closer to the lot line. The exchange of land is of equal area. This is being done because the building inspector has informed the applicant that the garage in not in conformance.
Ms. Burke noted that the other party has not signed the necessary forms and this must be done.
Dirk Underwood, seconded by Thomas Collins, made a motion to accept the plan entitled “Plan of Land in Hudson, MA” as drawn by Thomas Land Surveyors and Engineering Consultants of Hudson, MA dated August 19, 2010 and authorize the Agent to sign, contingent on the appropriate signatures being submitted.
Vote: 4-0-0, Unanimous
1 Redco Road
Tom Collins recused himself.
Mr. DiPersio explained that the applicant is seeking to swap a piece of land with his neighbor in order shift the lot lines to have the proper setbacks to build a pool house on his property.
The Board had no issues with the plan.
Bob D’Amelio, seconded by David Daigneault, made a motion to accept the plan entitled “Plan of Land in Hudson, MA” as drawn by Thomas Land Surveyors and Engineering Consultants of Hudson, MA dated August 3, 2010 and authorize the Agent to sign, contingent on the appropriate signatures being submitted.
Vote: 3-0-0, Unanimous
Tom Collins returned to the Board.
Discussions
Executive Session
Ms. Burke explained that recently the legislature approved a new law regarding projects that were approved between August 2008 and August 2010. These projects would all be subject to an automatic two year extension. She also noted that she had consulted with Town Counsel and he is proposing an executive session meeting between himself and the Board to discuss how this would effect pending litigation. The Board agreed to meet on Monday, September 13, 2010.
Highland Commons
Ms. Burke made reference to emails that have gone back and forth with SEA regarding a recent inspection of Highland Commons. It was noticed that there are cracks in the wall of the sediment forebay. Mr. Hoffman responded to Ms. Burke and stated that the survey points need to be resurvey to confirm that the retaining wall has not moved.
Mr. D’Amelio wants the survey completed by September 30, 2010. Ms. Burke notes that she will send a letter to the developer as well as to Mr. Hoffman.

Vote: 3-0-1, Bob D’Amelio not voting.
